Draft Regulations

National Treasury has distributed the Draft Regulations to the Public Procurement Act amongst Ministers, Departments, and Municipalities for their input, and it seems that there is movement on finalising them within this calendar year.

How will these regulations impact your business tendering for government contracts, since the Act itself talks about set-asides for certain persons or categories of persons?

Would some businesses be required to change their ownership structures to ensure that they could continue to be allowed to tender?

What could the Constitutional Court decide on whether the Act is lawful or not, since certain entities have petitioned it, arguing that no proper consultation process was followed?

Our view is that, despite such legal challenges, we will see legal changes to public sector procurement within the next 12 months.
